RESOLUTION NO. RS2009-1067

A resolution requesting the Mayor and the Director of Public Property Administration to retain possession and control of property located at the corner of the Lebanon Pike and Stewart’s Ferry Pike intersection until the appropriate use for the property is determined.

WHEREAS, in December 2008, the State of Tennessee transferred a 0.67-acre parcel of property located at the corner of the intersection of Lebanon Pike and Stewart’s Ferry Pike to the Metropolitan Government; and

WHEREAS, Stewart’s Ferry Pike was once a municipal toll road and the toll booth was located on this parcel of property; and

WHEREAS, upon the cessation of the operation of Stewart’s Ferry Pike as a toll road, the State of Tennessee operated a roadside picnic park on this site until the early 1970’s when it was abandoned, and the site has remained vacant since the State discontinued operation of the park; and

WHEREAS, this property has a rich local history that should be preserved for the benefit of current and future generations; and

WHEREAS, numerous members of the local community and the local ‘Gateway’ Committee have voiced a desire to have this site designated an eastern ‘Gateway’ park that would provide an entrance to the Donelson Business District and would balance the western ‘Gateway’ park at Briley Parkway; and

WHEREAS, the Donelson-Hermitage Chamber of Commerce desires to designate this site as an historic toll gate picnic park that would substantially enhance the community environment of the area; and

WHEREAS, due to its location at the intersection of the Lebanon Pike and Stewart’s Ferry Pike, which demand immediate upgrades, this site should be considered an important piece of an upgrade proposal; and

WHEREAS, it is fitting and proper that this property remain under the control of the Director of Public Property Administration until such time as the Metropolitan Government, with the input and cooperation of the local community, establishes a beneficial use of the site to enhance the area and connect the upgrades to the Lebanon Pike and Stewart’s Ferry Pike corridors.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor and the Director of Public Property Administration to retain possession and control of property located at the corner of the Lebanon Pike and Stewart’s Ferry Pike intersection until the appropriate use for the property is determined.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Mayor Karl Dean and to Director of Public Property Administration Gene Nolan.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
