RESOLUTION NO. RS2009-1054

A resolution approving a contract between the State of Tennessee, Department of Mental Health and Developmental Disabilities, and The Metropolitan Government of Nashville and Davidson County for inpatient mental health evaluations of minors at the rate of $450 per day for the Davidson County Juvenile Court.

WHEREAS, T.C.A Section 37-1-128(e) authorizes Juvenile Court judges to order mental health evaluations of children on either an outpatient basis or an inpatient basis; and,

WHEREAS, such evaluations can result in a child being held for up to thirty (30) days; and,

WHEREAS, the payment of the direct costs of such inpatient evaluations are typically the responsibility of the juvenile’s parent or guardian, but the state may continue to pay for outpatient evaluations; and,

WHEREAS, a per diem rate will be charged for inpatient juvenile mental health evaluations conducted at Middle Tennessee Mental Health Institute; and,

WHEREAS, the attached agreement establishes the per diem rate for inpatient mental health evaluations ordered by Juvenile Court at $450 per day, as opposed to the normal statutory per diem rate of $900; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the contract by and between the State of Tennessee, Department of Mental Health, for inpatient mental health evaluations of minors at the rate of $450 per day for the Davidson County Juvenile Court, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2: That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
