RESOLUTION NO. RS2009-1011

A resolution encouraging the Metropolitan Department of Water and Sewerage Services and the Department of Public Works to give written notice to satellite cities of road cuts within their jurisdictions and to post an adequate bond to ensure road repairs are made.

WHEREAS, there are currently six satellite cities within the General Services District of the Metropolitan Government of Nashville and Davidson County that retained their status as incorporated cities when the Metropolitan Government was created in 1963; and

WHEREAS, several of the satellite cities provide for the planning, construction, and maintenance of the streets and roads within the boundaries of their respective city limits; and

WHEREAS, from time to time, it is necessary for the Metropolitan Government to cut or otherwise open a road or road right-of-way within a satellite city in order to access underground utilities, or for other government purposes; and

WHEREAS, the satellite cities in which the Metropolitan Government is performing road work should be notified prior to such work and should have assurance that the road will be restored to its original condition.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as encouraging the Metropolitan Department of Water and Sewerage Services and the Department of Public Works to give written notice to satellite cities of road cuts within their jurisdictions and to post an adequate bond to ensure appropriate repairs are made to the damaged road to return the road to its original condition. Such written notice and bond should be sent to the City Manager of the affected satellite city at least three business days prior to the commencement of the road cut or road repairs, except in the event of an emergency.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to the Directors of the Department of Water and Sewerage Services and the Department of Public Works.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
