RESOLUTION NO. RS2009-1006
A resolution approving and authorizing the Mayor to execute amendment one to each of the seven contracts between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, for the receipt of funds through the American Recovery and Reinvestment Act of 2009 (ARRA) for seven infrastructure projects in Davidson County.
WHEREAS, by Resolution 2009-827, the Metropolitan Council approved contracts with the State of Tennessee, Department of Transportation (“TDOT”), to provide funding for the seven infrastructure projects listed below; and,
WHEREAS, the seven contracts are offered for the purpose of advancing the infrastructure projects by using funds made available by the passage of the American Recovery and Reinvestment Act of 2009 (ARRA); and,
WHEREAS, the parties now wish to amend the seven contracts by adding additional federally required ARRA language and other provisions, as set forth in the seven amendments, copies of which are attached hereto; and,
WHEREAS, The State of Tennessee, Department of Transportation, proposes in the amendments to provide funding through the ARRA for the seven infrastructure projects as listed below:

WHEREAS, pursuant to BL2002-1186, all grants awards requiring Council approval may be approved by resolution; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment ones to each of the seven infrastructure projects be accepted.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That amendment one for Contract Numbers 90204, 90209, 90210, 90111, 90112, 90113, 90215 between the State of Tennessee, Tennessee Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, copies of which are attached hereto and incorporated herein, are hereby approved, and the Metropolitan Mayor is authorized the execute the same.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
