RESOLUTION NO. RS2008-590

A resolution approving an amendment and assignment of a lease between the Metropolitan Government, MFP Baseball, LLC, and the Nashville Sounds Baseball Club, L.P. for a parcel of property commonly known as Greer Stadium (Planning Commission No. 2008M-232).

WHEREAS, pursuant to Ordinance No. O98-1044, the Metropolitan Council approved an amended and restated lease (the “Lease”) between the Metropolitan Government and the Nashville Sounds Baseball Club, L.P. (“Sounds”) for the property commonly known as Greer Stadium; and

WHEREAS, the parties previously amended the lease by Resolution RS2002-955; and

WHEREAS, the parties desire to again amend the Lease to extend its term and to assign the Lease; and

WHEREAS, the citizens of Nashville and Davidson County will benefit from the approval of this Second Amendment to the Lease.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The proposed assignment of the Lease by the Nashville Sounds Baseball Club, L.P. to MFP Baseball, LLC, and the Second Amendment to the Lease between the Metropolitan Government and MFP Baseball, LLC (Exhibit A) is hereby approved.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
