RESOLUTION NO. RS2008-579

A resolution approving an Amendment to an Intergovernmental Service Agreement between the United States Department of Homeland Security Immigration and Customs Enforcement and The Metropolitan Government of Nashville and Davidson County.

WHEREAS, by Resolution No. RS2007-2123, the Metropolitan Council previously approved an Intergovernmental Service Agreement between the Metropolitan Government, by and through the Davidson County Sheriff’s Office, and the United States Department of Homeland Security Immigration and Customs Enforcement to provide for the detention and care of administrative detainees; and,

WHEREAS, the United States Department of Homeland Security Immigration and Customs Enforcement and the Davidson County Sheriff’s Office have executed an Amendment to the Intergovernmental Service Agreement, attached hereto and incorporated herein, to include the Service Contract Act, 41 U.S.C. 351 et seq., Title 26, Part 4, Labor Standards for Federal Service Contracts clause, the prevailing Wage Determination for Davidson County, and the security requirement for employment screening; and,

WHEREAS, approval of the Amendment will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Amendment to the Intergovernmental Service Agreement between the United States Department of Homeland Security Immigration and Customs Enforcement and The Metropolitan Government of Nashville and Davidson County, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
