RESOLUTION NO. RS2008-574

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, by and through the Tennessee Emergency Management Agency, to accept grant funds to be distributed between the various counties in Urban Area/ Homeland Security District 5 for homeland security projects.

WHEREAS, the Metropolitan Government currently serves as the host municipality for Urban Area/ Homeland Security District 5 (“District 5”); and,

WHEREAS, District 5 receives funds from the Tennessee Emergency Management Agency (“TEMA”) under Homeland Security Grant No. 2008-GE-T8-0048, which is administered by the United States Department of Homeland Security; and,

WHEREAS, District 5 has been awarded funds pursuant to this grant in an amount not to exceed $3,168,566.91, to be distributed between the various counties of District 5; and,

WHEREAS, these grant funds will include $1,597,383.91 for use by the Metropolitan Government for homeland security projects; and,

WHEREAS, this grant program requires an intergovernmental agreement in the form of a “Letter of Acceptance” from the District 5 host county to before grant contracts can be generated; and,

WHEREAS, T.C.A. § 12-9-104 authorizes the Metropolitan Government to enter into intergovernmental agreements with agencies of the state government with the approval of the Metropolitan Council by resolution; and,

WHEREAS, it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, by and through the Tennessee Emergency Management Agency, to accept funds in the amount of $3,168,566.91 on behalf of Urban Area/ Homeland Security District 5, is hereby approved and the Metropolitan Mayor is hereby authorized to execute the same.

Section 2. That this resolution shall become effective from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
