RESOLUTION NO. RS2008-520

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Lana and Jack Copeland against the Metropolitan Government of Nashville and Davidson County in the amount of $52,500.00, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on May 26, 2006, Julio Sanchez, an employee of the Water Services Department, while operating a vehicle owned by the Metropolitan Government, was involved in an accident which caused personal injury to Lana Copeland; and,

WHEREAS, on May 17, 2007, Mrs. Copeland, and her husband, Jack Copeland, brought suit against the Metropolitan Government for injuries suffered as a result of the accident; and,

WHEREAS, after investigation, the Department of Law believes that the settlement amount listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the lawsuit be compromised and settled.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claims of Lana Copeland, and her husband, Jack Copeland, in the amount of $52,500.00 with said amount to be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
