RESOLUTION NO. RS2008-518
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Lamont J. Bell against The Metropolitan Government of Nashville and Davidson County in the amount of $165,000.00, and that said amount be paid out of the Self-Insured Liability Fund.
WHEREAS, Lamont J. Bell was injured on October 27, 2004 when the vehicle he was driving was struck head-on while traveling in the eastbound lane of Haywood Lane by a Department of Public Works recycling vehicle driven by a Metropolitan Government employee in the course and scope of his employment; and,
WHEREAS, Lamont J. Bell brought suit against the Metropolitan Government for injuries suffered as a result of the accident; and,
WHEREAS, after investigation, the Department of Law believes that the settlement amount listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the lawsuit Lamont J. Bell v. Metropolitan Government, currently pending in the Circuit Court of Davidson County, Docket No. 05C-2790, for the sum of $165,000.00, and that said amount be paid out of the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
