RESOLUTION NO. RS2008-470

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Election Commission, and Election Systems & Software, Inc., for the lease of voting equipment.

WHEREAS, section 5.04.020 of the Metropolitan Code provides that all leases of equipment shall be approved by resolution of the Metropolitan Council if the annual expenditure for the lease exceeds five thousand dollars ($5,000) per year; and,

WHEREAS, the annual expenditure to lease voting equipment for use by the Davidson County Election Commission, pursuant to the attached contract with Election Systems & Software, Inc., will exceed five thousand dollars ($5,000) per year; and,

WHEREAS, the Metropolitan Government has previously entered into contract number 16302 with Election Systems & Software Inc., for the period of June 1, 2006 through May 31, 2011, for the purchase of voting equipment, which was procured by Request for Proposal Number 06-15; and,

WHEREAS, the State of Tennessee has awarded a grant in an amount of $135,000.00 to the Davidson County Election Commission for the lease of voting machines for the November 2008 election; and

WHEREAS it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Election Commission, and Election Systems & Software, Inc., for the lease of voting equipment, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
