RESOLUTION NO. RS2008-422

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Debra L. Davis against The Metropolitan Government of Nashville and Davidson County in the amount of $13,000.

WHEREAS, Debra L. Davis was injured when her car, traveling eastbound on I-40 near the Fairfield Avenue entrance ramp, was struck from behind by a Department of Public Works garbage truck driven by a Metropolitan employee in the course and scope of his employment; and,

WHEREAS, Debra L. Davis brought suit against the Metropolitan Government for injuries suffered as a result of the accident and property damage; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the lawsuit Debra Davis v. Metropolitan Government, currently pending in the Circuit Court of Davidson County Docket No. 06C-1989, for the sum of $13,000, and that this amount be paid out of the self-insured liability fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
