RESOLUTION NO. RS2008-364

A resolution approving an amendment to a lease agreement between The State of Tennessee and The Metropolitan Government of Nashville and Davidson County, Tennessee for certain portions of the campus at the Tennessee Preparatory School located in Nashville, Tennessee for The Metropolitan Government’s Magnet School Program.

WHEREAS, Metropolitan Code of Laws Section 2.24.210 provides that, “Any lease of public property, except leases of space in the Stahlman Building, shall be subject to the approval of the Metropolitan Council;” and,

WHEREAS, The Metropolitan Government entered into a lease dated June 16, 2003 for portions of the campus of the Tennessee Preparatory School (the “Property”) which was approved by Ordinance No. BL2003-1390; and,

WHEREAS, the parties desire to amend the lease, to extend the term of the original lease for an additional six (6) months from August 1, 2008 to January 31, 2009, a copy of which Amendment 1 is attached hereto; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Director of Public Property, has negotiated an amendment to the lease agreement with The State of Tennessee; and,

WHEREAS, Ordinance No. BL2003-1390 provided that any amendments to the lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this amendment to the lease agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment 1 to the lease between The State of Tennessee and The Metropolitan Government of Nashville and Davidson County, a copy of which lease amendment is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
