RESOLUTION NO. RS2008-352
A resolution authorizing the Metropolitan Department of Law to compromise and settle Mark and Sylvia Young’s claims against the Metropolitan Government for the amount of $251,428.00, and directing that this amount be paid from the Self-Insured Liability Fund.
WHEREAS, on May 10, 2006, Mark Young, an on-duty firefighter with the Nashville Fire Department, sustained injuries while riding as a passenger on a rescue truck, that was involved in a single vehicle roll-over accident en route to a reported fire; and,
WHEREAS, on February 16, 2007, Mark Young, and his wife, Sylvia Young, initiated a civil action against the Metropolitan Government in Davidson County Circuit Court; and,
WHEREAS, the Department of Law believes that the settlement set forth in Section 1 is fair, reasonable, and in the Metropolitan Government’s best interest;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claims of Mark Young, and his wife, Sylvia Young, in the amount of $251,428.00 with said amount to be paid from the Self-Insured Liability Fund.
Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
