RESOLUTION NO. RS2008-350

A resolution accepting a substitute grant from the State of Tennessee, Department of Environment and Conservation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the purpose of collecting and disposing of waste tires.

Whereas, the Metropolitan Council recently passed RS2008-322 accepting a grant from the State of Tennessee, Department of Environment and Conservation for the purpose of collecting and disposing of waste tires; and,

Whereas, a provision of the original grant agreement was inadvertently omitted; and,

Whereas, the original grant is now being replaced with a substitute grant which contains the appropriate terms of agreement; and,

Whereas, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this substitute grant be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the substitute grant by and between the State of Tennessee, Department of Environment and Conservation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the purpose of collecting and disposing of waste tires, in an amount not to exceed $1,785,000.00 a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan County Mayor is authorized to execute the same.

Section 2. That the amount of this substitute grant is hereby appropriated to the Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
