RESOLUTION NO. RS2008-309

A resolution authorizing the Metropolitan Department of Law to compromise and settle the subrogation claim of The Metropolitan Government of Nashville and Davidson County against Elizabeth R. Gilmore and Thomas M. Gilmore in the amount of $19,371.00.

Whereas, on January 7, 2005, Angela P. Page, an employee of the Metropolitan Police Department of the Metropolitan Government of Nashville and Davidson County, while operating a Metropolitan police vehicle in the course and scope of her employment at or near 2330 Elliston Place, collided with a motor vehicle being driven by Elizabeth R. Gilmore and owned by Thomas M. Gilmore; and

Whereas, a lawsuit was filed by Metropolitan employee and plaintiff, Angela P. Page, in the First Circuit Court for Davidson County, Tennessee; and

Whereas, the Metropolitan Government has a subrogation interest in this lawsuit relating to the injury-on-duty pay and medical expense received by employee, Angela P. Page; and

Whereas, after investigation, the Metropolitan Government Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that this lawsuit be compromised and settled.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its subrogation interest relating to the lawsuit of Metropolitan employee, Angela P. Page v. Elizabeth R. Gilmore and Thomas M. Gilmore, currently pending in the First Circuit Court, Docket No. 06C-23 for the sum of $19,371.00, and that this amount be deposited into the appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
