RESOLUTION NO. RS2008-300
A Resolution approving the exercise of fee simple acquisition options for the purchase of various flood prone properties, for Metro Water Services Project No. 02-D-149 (Proposal No. 2002M-111U-12).
WHEREAS, it is in the public interest for The Metropolitan Government of Nashville and Davidson County to acquire certain flood-prone properties; and,
WHEREAS, the Properties shown on the list below are flood-prone; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:
“Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the Director of Public Property shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan Government at a fixed price subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council”; and,
WHEREAS, pursuant to the terms of the documents collectively attached and the Fee Simple Acquisition Options to this resolution, Options permitting the Metropolitan Government to purchase the Property have been obtained; and,
WHEREAS, the purchase of the properties, identified as Metro Water Services Project No. 02-D-149, has been funded under Business Unit No. 65701720, Fund No. 37100 and approved by the Metropolitan Planning Commission on October 29, 2002, Proposal Number 2002M-111U-12.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
Section 1. The Director of Public Property, or his designee, is hereby authorized to exercise the Fee Simple Acquisition Options attached and to execute such documents as may be necessary to effect the acquisition of the Property by the Metropolitan Government.
Section 2. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
