RESOLUTION NO. RS2008-244

A resolution approving an amendment to a grant from the State of Tennessee, Department of Environment and Conservation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, increasing the grant by an amount not to exceed $145,000.00 for the purpose of collecting and disposing of waste tires.

Whereas, The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, previously entered into a Grant Agreement with the State of Tennessee, Department of Environment and Conservation, pursuant to which the Metropolitan Government was awarded a grant for the purpose of collecting and disposing of waste tires, in an amount not to exceed $450,000, which Grant Agreement was approved by the Metropolitan Council by Resolution 2007-2058; and,

WHEREAS, the parties wish to amend that Grant Agreement, as provided in Amendment 1, a copy of which is attached hereto; and,

WHEREAS, Amendment 1 adds $145,000.00 to the original grant amount, increasing the amount of the grant to the Metropolitan Government to an amount not to exceed $595,000.00; and,

Whereas, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this grant be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment 1 to the Grant Agreement grant by and between the State of Tennessee, Department of Environment and Conservation, providing for a total amount not to exceed $595,000.00 to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the purpose of collecting and disposing of waste tires, a copy of which Amendment is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this grant for fiscal year 2007/2008, not to exceed $595,000.00 is hereby appropriated to the Metropolitan Department of Public Works in the current fiscal year’s budget, based on the revenues estimated to be received and any match to be applied.

Section 3. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
