RESOLUTION NO. BL2008-234

A proposed resolution to establish an alternative, lower fee for applications to request minor changes to an adopted overlay district or specific plan district that must be approved by the Metro Council (Proposal No. 2008Z-012T).

WHEREAS, pursuant to the authority of Section 17.40.760 of the Metropolitan Code of Laws, the Planning Department has developed for the Metropolitan Council’s consideration an alternative, lower fee for applications to request minor changes to an adopted overlay district or Specific Plan district that must be approved by the Metro Council, and

WHEREAS, pursuant to Section 17.40.740 of the Metropolitan Code of Laws, the adoption of a new fee may be accomplished by resolution; and

WHEREAS, the Metro Council finds, based on the Planning Department’s recommendation, it fitting and proper to revise the overlay district and specific plan district application fees by creating a lower fee for applications to request minor changes to an adopted overlay district or Specific Plan district that must be approved by the Metro Council,;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the application fee for applications to request minor changes to an adopted overlay district or Specific Plan district that must be approved by the Metro Council, shall be $470 and is hereby established as the fee for such zoning-related applications.
Section 2. That, upon adoption, this plan shall be kept on file and made available to the public at the Metropolitan Planning Department.
Section 3. That this resolution shall take effect after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
