RESOLUTION NO. RS2008-230

A resolution requesting the Metropolitan Development and Housing Agency, the Nashville Electric Service, the Metropolitan Transit Authority, the Metropolitan Nashville Public Schools, the Metropolitan Hospital Authority, the Metropolitan Sports Authority and the Metropolitan Nashville Airport Authority to adopt and implement the provisions of the Metropolitan Procurement Nondiscrimination Program.

WHEREAS, on April 1, 2008, the Metropolitan Council enacted Ordinance No. BL2008-161, a copy of which is attached hereto, establishing a procurement nondiscrimination program for the Metropolitan Government; and

WHEREAS, Ordinance No. BL2008-161 was drafted with the assistance of Griffin & Strong, P.C., in response to the results of two disparity studies, which concluded that the Metropolitan Government had become a passive participant in discrimination based upon race, gender or ethnicity; and

WHEREAS, the most recent disparity study completed in 2005 utilized data submitted by the Metropolitan Government purchasing department, as well as the following agencies: Metropolitan Nashville Airport Authority (MNAA), Metropolitan Development and Housing Agency (MDHA), Nashville Electric Service (NES), Metropolitan Nashville Public Schools (MNPS), and Metropolitan Transit Authority (MTA); and

WHEREAS, although MNAA, MDHA, NES, MNPS, and MTA were included as part of the disparity study, and although some of the agencies receive taxpayer funding through the Metropolitan Government, they are expressly excluded from Ordinance No. BL2008-161 due to Charter and state law restrictions on the ability of the Metropolitan Government to regulate these agencies; and

WHEREAS, in order to promote a level playing field regarding the use of minority and women-owned businesses in the procurement process across the entire realm of Metropolitan Government, the Metropolitan Council deems it fitting and proper to formally request MNAA, MDHA, NES, MNPS, and MTA to adopt the provisions of the Metropolitan Government Procurement Nondiscrimination Program.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Development and Housing Agency, Nashville Electric Service, Metropolitan Transit Authority, the Metropolitan Nashville Public Schools, the Metropolitan Hospital Authority, the Metropolitan Sports Authority and the Metropolitan Nashville Airport Authority to adopt and implement the provisions of the Metropolitan Procurement Nondiscrimination Program.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to the Metropolitan Development and Housing Agency, Nashville Electric Service, Metropolitan Transit Authority, the Metropolitan Nashville Public Schools, the Metropolitan Hospital Authority, the Metropolitan Sports Authority and the Metropolitan Nashville Airport Authority.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
