RESOLUTION NO. RS2008-229
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to impose a two-term limit on members of the Metropolitan Board of Public Education.
WHEREAS, Section 1.07 of the Metropolitan Charter limits holders of elected offices created or authorized by the Charter to serving two consecutive terms; and
WHEREAS, an elected Metropolitan Board of Public Education was established by an amendment to the Charter in 1980; and
WHEREAS, the Tennessee General Assembly enacted Tenn. Code Ann. § 49-2-201 in 1992 to provide for elected boards of education across the state of Tennessee; and
WHEREAS, Tenn. Code Ann. § 49-2-201 provides that members of the Board of Education are to be elected for four-year terms and “may succeed themselves”; and
WHEREAS, it is fitting and proper that the state law be amended to limit the Metropolitan Board of Public Education to two consecutive four-year terms to be consistent with the Metropolitan Charter provision applicable to other offices created or authorized by the Charter.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to impose a two-term limit on members of the Metropolitan Board of Public Education.
Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.
Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
