RESOLUTION NO. RS2008-193

A resolution approving the tree bank fee schedule recommended by the Tree Ordinance Task Force and promulgated by the Urban Forester.

WHEREAS, Section 17.40.480 of the Metropolitan Code provides for the establishment of a tree bank, with contributions thereto to be made pursuant to a fee schedule promulgated by the Urban Forester and approved by resolution of Council; and

WHEREAS, on November 20, 2007, the Metropolitan Council adopted Resolution No. RS2007-75 requesting the Vice Mayor to appoint a task force to determine the appropriate tree bank fee schedule and to propose such other amendments as may be necessary to accommodate the Tennessee Court of Appeals ruling in Western Express, Inc. v. Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the Tree Ordinance Task Force appointed by the Vice Mayor submitted a report on February 27, 2008, recommending that the tree bank option remain in the Zoning Code for properties that are not suitable for planting trees, and recommending the appropriate fee schedule for payment into the tree bank when such payments are warranted; and

WHEREAS, the Urban Forester has promulgated the attached fee schedule recommended by the Tree Ordinance Task Force, which represents the costs of providing the required tree densities.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the tree bank fee schedule promulgated by the Urban Forester and recommended by the Tree Ordinance Task Force, attached hereto and incorporated herein as Exhibit A, is hereby approved.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
