RESOLUTION NO. RS2008-172

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Naomi Halsey McClure against The Metropolitan Government of Nashville and Davidson County in the amount of $130,000 to be paid from the Self-Insured Liability Fund.

Whereas, Naomi Halsey McClure was injured when the tire of her bicycle became lodged in a storm grate near the intersection of Church Street and Ninth Avenue North; and

Whereas, Naomi Halsey McClure brought suit against the Metropolitan Government for injuries suffered as a result of the accident; and

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the personal injury claim22 of Naomi Halsey McClure v. Metropolitan Government, currently pending in the Circuit Court of Davidson County Docket No. 07C-1589, for the sum of $130,000, and that this amount shall be paid out of the self-insured liability fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
