RESOLUTION NO. RS2007-72

A resolution authorizing the Metropolitan Department of Law to compromise and settle the recovery claim of The Metropolitan Government of Nashville and Davidson County against Elizabeth Rich.

Whereas, on September 12, 2006, Jerry Ham, an employee of The Metropolitan Government of Nashville and Davidson County Codes Department, while operating a vehicle owned by the Metropolitan Government, was involved in an accident which resulted in personal injury to Mr. Ham; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the Metropolitan Government accept payment in the amount of $5,705.53 as compensation for all expenses incurred by the Metropolitan Government resulting from the personal injury to Mr. Ham.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the recovery claim against Elizabeth Rich in an amount totaling $5,705.53, and that this amount be deposited into the appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
