RESOLUTION NO. RS2007-67

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Michael McDaniel against The Metropolitan Government of Nashville and Davidson County.

Whereas, on March 2, 2007, Ronald Holt, an employee of The Metropolitan Government of Nashville and Davidson County Fire Department, while operating a vehicle owned by the Metropolitan Government, was involved in an accident which caused personal injuries to Michael McDaniel; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the claim be compromised and settled in the amount of $12,000.00, and that this amount be paid from the Self Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Michael McDaniel in an amount totaling $12,000.00. Said amount shall be paid from the Self Insured liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Resolution No. RS2007-67 by deleting the phrase “Ronald Holt, an employee of The Metropolitan Government of Nashville and Davidson County Fire Department”, wherein it appears in the first recital clause, and substituting in lieu thereof the phrase “Randy Morgan, an employee of the Office of Emergency Management”.
