RESOLUTION NO. RS2007-36
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Leeann Cosby against The Metropolitan Government of Nashville and Davidson County for $38,000.00.
Whereas, on February 28, 2006, James E. Blackwell, an employee of The Metropolitan Government of Nashville and Davidson County, Department of Water Services, while operating a vehicle owned by the Metropolitan Government, struck the rear-end of a vehicle owned and operated by Leeann Cosby, resulting in property damage to the vehicle and personal injury to Leeann Cosby, and;
Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and is in the best interest of the Metropolitan Government, and recommends that the claim be compromised and settled for $38,000.00, and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Leeann Cosby for $38,000.00. Said amount shall be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
