A resolution approving an Intergovernmental Service Agreement between the United States Department of Homeland Security Immigration and Customs Enforcement and The Metropolitan Government of Nashville and Davidson County to provide for the detention and care of administrative detainees.

WHEREAS, the United States Department of Homeland Security Immigration and Customs Enforcement (“ICE”) and the Metropolitan Government, by and through the Davidson County Sheriff’s Office (“DCSO”), previously entered a Memorandum of Agreement to allow certain DCSO officers to perform official immigration functions, which Memorandum of Agreement was approved by Resolution No. RS2007-1763; and,

WHEREAS, the Memorandum of Agreement provided that DCSO and ICE could enter into an Intergovernmental Service Agreement by which DCSO would provide the detention of administrative detainees who had completed their local sentences but were detainable under the Immigration and Nationality Act, as amended, and that ICE would reimburse DCSO for such detention services; and,

WHEREAS, DCSO and ICE have negotiated and agreed upon reasonable reimbursement and terms regarding the provision of detention services, as set forth in the Intergovernmental Service Agreement attached hereto and incorporated herein; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that such Intergovernmental Service Agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Intergovernmental Service Agreement between The Metropolitan Government of Nashville and Davidson County and the United States Department of Homeland Security, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is hereby authorized to execute the same on behalf of the Metropolitan Government.

Section 2: That any amendments to the terms of the Intergovernmental Service Agreement must be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That any funds received pursuant to this Intergovernmental Agreement shall be appropriated to the Davidson County Sheriff’s Office.

Section 4: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
