A resolution removing Mr. Don Driscoll as a member of the Industrial Development Board.

WHEREAS, the Industrial Development Board for the City of Nashville was established in 1959 by Resolution No. R59-1740, in accordance with the provisions of the Industrial Development Corporation Act of 1955, as amended; and

WHEREAS, T.C. A., § 7-53-301, as amended, provides that all members of the Board of Directors for the Industrial Development Board shall be elected by the governing body of the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, pursuant to Resolution No. RS2003-58, the Metropolitan Council elected Mr. Don Driscoll to serve on the Industrial Development Board for a six year term beginning November 4, 2003 and expiring August 23, 2009; and

WHEREAS, T.C. A., § 7-53-301 requires all members of the Industrial Development Board to be duly qualified electors and taxpayers of the Metropolitan Government; and

WHEREAS, Mr. Don Driscoll no longer resides within the area of the Metropolitan Government; and

WHEREAS, Mr. Don Driscoll has not submitted a letter of resignation from the Industrial Development Board, which would allow the Council to fill the vacant position; and

WHEREAS, Rule 44 of the Council Rules of Procedure provides a mechanism to remove members of boards and commissions by resolution of the council; and

WHEREAS, it is fitting and proper that the Metropolitan Council remove Mr. Don Driscoll from the Industrial Development Board since he is no longer a resident of Nashville and Davidson County.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby removes Mr. Don Driscoll as a member of the Industrial Development Board.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
