A resolution approving and authorizing the Metropolitan Mayor to enter into Supplemental Agreement No. 500,090, with Nashville and Eastern Railroad Corporation relating to a track crossing at M.P. 1.14 Old Hickory Boulevard in Nashville, Tennessee.

WHEREAS, Nashville and Eastern Railroad Corporation (the “Railroad”) owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services maintains a sewer line (the “Line”) that crosses at the Railroad’s tracks at M.P. 1.14 of Old Hickory Boulevard; and

WHEREAS, the parties propose to amend the Supplemental Agreement No. 500,090 as shown in the document attached as Exhibit 1 hereto, which will permit the continued use of the Line;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That Supplemental Agreement No. 500,090, attached hereto as Exhibit 1 and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
