RESOLUTION NO. RS2007-1836

A resolution approving the compromise and settlement of the lawsuit of Gregory S. Gaines and Gina Gaines against the Metropolitan Government of Nashville and Davidson County for the amount of $180,000.00 and directing that this amount be paid out of the Self-Insured Liability Fund.

Whereas, on September 10, 2004, a vehicle owned and driven by Gregory S. Gaines was struck on Interstate 65 North in Davidson County by a vehicle owned by the Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and driven by an employee of the Metropolitan Police Department, acting within the course and scope of his employment and, thereby causing injury to Gregory S. Gaines and damage to his vehicle; and,

Whereas, as a result of this collision, Gregory S. Gaines and Gina Gaines filed a lawsuit against the Metropolitan Government; and,

Whereas, after a thorough investigation of this accident, the Department of Law believes that the settlement set forth in Section 1 below is fair and reasonable, and recommends that this lawsuit be compromised and settled and that said amount be paid out of the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Gregory S. Gaines and Gina Gaines against the Metropolitan Government for the amount of $180,000.00 and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
