RESOLUTION NO. RS2007-1756

A resolution requesting the Metropolitan Board of Public Education to provide information to the Council detailing the compensation and benefits package for the Director of Schools.

WHEREAS, on October 18, 2006, the Metropolitan Board of Public Education voted to extend Director of Schools Dr. Pedro Garcia's contract for three years and gave Dr. Garcia a $16,600 raise, which increases the Director's annual salary to $216,000; and

WHEREAS, the Council Office, on behalf of Members of Council, has requested information from the Board of Education in the past pertaining to the compensation and benefits provided to the Director of Schools; and

WHEREAS, although the Board of Education has provided some information in response to the requests, the Council still has not received a complete breakdown of all of the compensation and fringe benefits provided to Dr. Garcia; and

WHEREAS, Tennessee Code Annotated § 10-7-503 provides that all state, county and municipal records are public records which must be open to public inspection; and

WHEREAS, it is fitting and proper that the Board of Education provide the Council with the information requested in this Resolution as required by the Tennessee Open Records laws.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Board of Public Education to provide information to the Council detailing the compensation and benefits package for the Director of Schools. Such information shall include, but not be limited to, the following compensation and benefits with the corresponding cost or amounts, respectively: (1) the base salary for the Director of Schools; (2) health, dental and vision insurance coverage; (3) pension contributions; (4) automobile and gas allowance; (5) travel allowance; and (6) mobile telephone.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Dr. Pedro Garcia and to each member of the Metropolitan Board of Public Education.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
