RESOLUTION NO. RS2006-1676

A resolution requesting the Metropolitan Planning Commission to update the Council as to all changes in the subdivision regulations since 2004, and to inform the Council in the future whenever modifications to the subdivision regulations are proposed.

WHEREAS, under Tennessee law, the Metropolitan Planning Commission has the sole authority to adopt and implement subdivision regulations for the Metropolitan Government; and

WHEREAS, on March 9, 2006, the Planning Commission adopted new subdivision regulations applicable to all subdivision applications made after April 27, 2006; and

WHEREAS, the prior subdivision regulations had been in effect since 1991 and were last modified in 2004; and

WHEREAS, Members of Council have received concerns from constituents and developers who are not familiar with the significant changes in the subdivision regulations, and are encountering some unforeseen costs and obstacles in developing their property; and

WHEREAS, it is fitting and proper that the Metropolitan Planning Commission notify the Metropolitan Council as to the substance of the recent changes in subdivision regulations, as well as inform the Council prior to enacting changes in the future.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Planning Commission to update the Council as to all changes in the subdivision regulations since 2004, and to inform the Council in the future whenever modifications to the subdivision regulations are proposed.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Rick Bernhardt, the Executive Director of the Metropolitan Planning Department, and to each member of the Metropolitan Planning Commission.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
