RESOLUTION NO. RS2006-1671

A resolution amending BL2005-924 by authorizing the acquisition of additional property by negotiation or condemnation with relation to the construction of a new high school in the Old Hickory Boulevard and I-24 East area, for the use and benefit of the Metropolitan Nashville Public Schools ( Proposal No. 2006M-189U-13).

WHEREAS, the Metropolitan Government is authorized by sections 2.01(12) and 2.01(5) of the Metropolitan Charter to provide for the taking and appropriation of real property within the area of the Metropolitan Government for any public purpose, when the public convenience requires it and in accordance with the provisions of Tennessee Code Annotated, Section 29-16-101 et seq., and also the power to purchase real property for any public purpose; and,

WHEREAS, Ordinance BL2005-924, adopted on February 22, 2006, authorized the acquisition of certain property by negotiation or condemnation for the development of a new high school in the Old Hickory Boulevard and I-24 East area; and,

WHEREAS, Ordinance BL2005-924 also provided that any amendments to the ordinance shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

WHEREAS, it is in the public interest that portions of two additional parcels, identified as 137.00 and 181.00 on Tax Map 175-00-0 and shown on Exhibit A hereto, are needed for infrastructure construction for the new high school.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF METROPOLITAN NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire by negotiation or condemnation portions of the property identified as Parcel 137.00 and Parcel 181.00 on Tax Map 175-00-0, and as shown in Exhibit "A" hereto.

Section 2. This Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
