RESOLUTION NO. RS2006-1643
A resolution authorizing the Metropolitan Department of Law to compromise and settle the breach of contract claim of Gilbert Companies, Inc. against the Metropolitan Government for the amount of $92,500.00, and directing that this amount be paid from the Public Works Waste Management Administration Fund.
Whereas, beginning in April of 1998, under an extension to a pre-existing contract, Gilbert Companies, Inc. performed stump removal and stump grinding services for the Metropolitan Government during the East Nashville tornado cleanup project,
Whereas, although Gilbert Companies did not provide adequate documentation for much of the work performed, it provided adequate documentation for a large quantity of work for which the Metropolitan Government never submitted payment; and,
Whereas, after investigation, the Department of Law believes the settlement of $92,500.00 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled, and that this amount be paid from the Public Works Waste Management Administration Fund.
Now therefore be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:
Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of Gilbert Companies, Inc. for the amount of $92,500.00, which amount shall be paid from the Public Works Waste Management Administration Fund.
Section 2. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
