RESOLUTION NO. RS2006-1642
A resolution authorizing the Metropolitan Department of Law to compromise and settle the wrongful death claim of Angela Rhoades, Mother and Best Friend of Angela Denham, a minor, against the Metropolitan Government for the amount of $100,000.00, and directing that this amount be paid from the Self-Insured Liability Fund.
Whereas, on December 4, 2005, James Denham, father of the Plaintiff, Angela Denham, died as a result of an accidental gunshot wound to the back while being handcuffed by a Metropolitan Police Department patrol officer; and,
Whereas, the shooting resulted from the patrol officer's failure to follow Police Department policy regarding weapon handling, and under applicable law, the Metropolitan Government would be liable for this negligence of its employee patrol officer; and,
Whereas, after investigation, the Department of Law believes the settlement of $100,000.00 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled, and that this amount be paid from the Self-Insured Liability Fund.
Now therefore be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:
Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of Angela Rhoades for the benefit of Angela Denham for the amount of $100,000.00, which amount shall be paid from the Self-Insured Liability Fund.
Section 2. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
