RESOLUTION NO. RS2006-1640

A resolution approving the exercise of a fee simple acquisition option for the purchase of flood prone property for Metro Water Services Project No. 02-D-149 (Proposal No. 2002M-111U-12).

WHEREAS, it is in the public interest for the Metropolitan Government to acquire certain flood-prone properties; and,

WHEREAS, the property ("Property") listed below and incorporated herein as Exhibit A is flood-prone; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides that "Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the Director of Public Property shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan Government at a fixed price subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council"; and,

WHEREAS, pursuant to the terms of the document attached to this resolution as Exhibit B, the Metropolitan Government has obtained an option to purchase the Property listed above; and,

WHEREAS, the Metropolitan Government has received a $1,971,765 federal grant to fund a substantial part of the purchase of the property; and,

WHEREAS, the purchase of the Property identified as Metro Water Services Project No. 02-D-149 has been funded under Capital Improvements Budget No. 02DG0013 and was approved by the Metropolitan Planning Commission on October 29, 2002, Proposal Number 2002M-111U-12.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property, or his designee, is hereby authorized to exercise the Fee Simple Acquisition Option attached and to execute such documents as may be necessary to effect the acquisition of the Property by the Metropolitan Government.


Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
