RESOLUTION NO. RS2006-1576
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of The Metropolitan Government of Nashville and Davidson County against Daryl Hutchison in the amount of $18,902.00.
Whereas, on January 23, 2005, as the plaintiff, Christopher Brennan, an employee of the Metropolitan Government, was traveling north on South Graycroft when Mr. Daryl Hutchison entered the intersection from Chadwell Drive and struck the Metro vehicle in the passenger side front door; and
Whereas, a lawsuit was filed by the plaintiff, Christopher Brennan, in the Circuit Court for Davidson County, Tennessee; and
Whereas, the Metropolitan Government has a subrogation interest in this lawsuit relating to the injury-on-duty medical bills and lost wages received by its employee, Christopher Brennan; and
Whereas, after investigation, the Metropolitan Government Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that this lawsuit be compromised and settled and that this amount be deposited into the appropriate fund and account as determined by the Department of Finance.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle its subrogation interest relating to the lawsuit of Christopher Brennan v. Daryl Hutchison, for the sum of $18,902.00, and that this amount be deposited into the appropriate fund and account as determined by the Department of Finance
Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
