A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5980, Supplement # 1 with the State of Tennessee, Department of Transportation, Project No. IM-40(118)213, 19008-2178-44, 1-40 widening and rehabilitation from 1-24 to Donelson Pike, located in Davidson County.

WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") plans to construct State Project No. IM-40(118)213, 19008-2178-44, in Davidson County: and

WHEREAS, Metropolitan Department of Water and Sewerage Services plans to construct the utility work identified as Project No. IM-40(118)213, 19008-2178-44, 1-40 widening and rehabilitation from 1-24 to Donelson Pike , identified in Capital Improvement Budget, No. 96WG005 and described in the attached Contract: and

WHEREAS, it is in the interest of the Metropolitan Government that this utility work be carried out simultaneously with the State project; and

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 5980, Supplement #1 (attached hereto as Exhibit A), the Metropolitan Government will be responsible for one hundred percent (100%) of the actual cost for the utility work, which cost is currently estimated to be $39,441.50.

WHEREAS, The Metropolitan Government is authorized by Ordinance No. 2005-935 to enter, by resolution, into Utility Relocation Contract No. 5980 with the Tennessee Department of Transportation; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is hereby authorized to enter into Utility Relocation Contract No.5980, Supplement #1, with the Tennessee Department of Transportation, attached hereto as Exhibit A, and made a part of this resolution by reference.

Section 2. That the Metropolitan Mayor is hereby authorized to enter into any supplemental agreements necessary to implement the Local Government Investment Pool Program.

Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Resolution No. RS2006-1555 as follows:

1. By deleting the fifth recital in its entirety and substituting in lieu thereof the following new clause:

WHEREAS, The Metropolitan Government is authorized by Ordinance No. 2003-1401 to enter, by resolution, into Utility Relocation Contract No. 5980 with the Tennessee Department of Transportation.

2. By substituting the attached copy of Ordinance No. BL2003-1401 in place of Ordinance No. BL2002-935 as an attachment to this Resolution.
