RESOLUTION NO. RS2006-1448

A resolution requesting the Metropolitan Department of Water and Sewerage Services to determine the feasibility of funding the stormwater program on the basis of a charge per parcel, and to study whether fees should be imposed concerning the review of stormwater plans for new developments.

WHEREAS, in fiscal year 2003, the stormwater management functions of the Metropolitan Government were transferred from the Department of Public Works to the Department of Water and Sewerage Services; and

WHEREAS, although a general fund transfer was made to the Water Department during fiscal year 2003 to subsidize the stormwater program, no such subsidy has been made in subsequent years; and

WHEREAS, the stormwater program is essentially funded by water and sewer rate payers, who may or may not see a direct benefit from the program; and

WHEREAS, while developers are required to pay a fee for water and sewer line inspections, there is no such fee for the review of stormwater plans for new developments; and

WHEREAS, in addition to other revenue enhancements for this fiscal year, the Department of Water and Sewerage Services has made a policy change to eliminate the sprinkler adjustment for residential customers watering their lawns in the summer months; and

WHEREAS, it is fitting and proper that the method for funding the stormwater program be thoroughly examined, and that developers be required to pay a fee for the review of stormwater plans.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Department of Water and Sewerage Services to determine the feasibility of funding the stormwater program on the basis of a charge per parcel, and to study whether fees should be imposed concerning the review of stormwater plans for new developments.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Scott Potter, the Director of the Department of Water Services.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
