SUBSTITUTE RESOLUTION NO. RS2006-1373

A resolution approving an amendment to a grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, extending the term of the grant and providing for additional funding.

WHEREAS, the Metropolitan Government of Nashville and Davidson County previously entered into a Grant Agreement with the State of Tennessee, Department of Environment and Conservation, for waste tire collection and disposal, which Grant Agreement was approved by the Metropolitan Council by Resolution RS2003-17; and,

WHEREAS, three prior Amendments to this Grant Agreement were approved by the Metropolitan Council by Resolutions RS2004-307, RS2004-355, and RS2005-860, increasing the amount of this grant and extending its term; and,

WHEREAS, the parties wish to again amend that Grant Agreement, as provided in Amendment 4 and 5, a copy of which is attached hereto; and,

WHEREAS, Amendment 4 and 5 extends the Grant Agreement until June 30, 2007, provides for a grant to the Metropolitan Government for 2006-2007 in an amount not to exceed $450,000, and increases the grant funding for 2005-2006 to $552,224.30; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this grant be amended.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment 4 and 5 to the Grant Agreement by and between the State of Tennessee, Department of Environment and Conservation, extending the term of the grant until June 30, 2007, increasing the amount of funding for 2005-2006 to $552,224.30, and providing for $450,000 to The Metropolitan Government of Nashville and Davidson County for waste tire collection and disposal, a copy of which Amendment is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this grant be appropriated to the Department of Public Works, based on the revenues estimated to be received and any match to be applied.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
