RESOLUTION NO. RS2006-1283

A resolution requesting the Mayor, the Director of Finance, all Metropolitan Government Departments, the Metropolitan Development and Housing Agency, and the Metropolitan Board of Public Education to provide the Metropolitan Council an ongoing report for all grants showing the number and percentage of minority employees and contractors.

WHEREAS, the Metropolitan Government receives millions of dollars in federal and state grants each year that are used to provide government services; and

WHEREAS, in the fiscal year 2006 operating budget for the Metropolitan Government, the Metropolitan Council appropriated approximately $3.5 million in grant funding to various nonprofit organizations in Davidson County; and

WHEREAS, the Metropolitan Development and Housing Agency (MDHA) is responsible for the oversight and implementation of redevelopment plans in Nashville's eight redevelopment districts; and

WHEREAS, as an encouragement to developers to undertake construction projects in the redevelopment districts, developers are eligible to receive assistance through various federal, state and local grants and tax incentive programs, such as the payment-in-lieu-of-taxes (PILOT) program, tax increment financing (TIF), and low-interest development loans for affordable housing; and

WHEREAS, it is the policy of the Metropolitan Government, the Metropolitan Development and Housing Agency and the Board of Public Education not to discriminate on the basis of age, race, sex, color, national origin, religion, or disability in their employment practices; and

WHEREAS, it is further the policy of the Metropolitan Government to encourage and enhance the participation of minority and women-owned businesses in procurement practices; and

WHEREAS, in an effort to further these policies, it is fitting and proper that the Metropolitan Council be provided with ongoing periodic reports regarding minority employees and contractors benefiting from grant funding.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor, the Director of Finance, all Metropolitan Government Departments, the Metropolitan Development and Housing Agency, and the Metropolitan Board of Public Education to provide the Metropolitan Council an ongoing report for all grants showing the number and percentage of minority employees and contractors. Such report should include, but not be limited to, the following information for all grants received or made by the Metropolitan Government:
1. The number and percentage of minority employees whose salaries are to be funded in whole or in part by the grant funds and the dollar amounts of those salaries.
2. The number, percentage, and dollar amounts going to minority contractors.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Mayor Bill Purcell, to Director of Finance David Manning, to Phil Ryan, the Executive Director of the Metropolitan Development and Housing Agency, to Dr. Pedro Garcia, the Director of Schools, and to each Metropolitan Government department head.

Section 3. That the Mayor, the Director of Finance, the Executive Director of MDHA, and the Director of Schools are further requested to respond to the Council as to the feasibility of and/or action taken in compliance with the request stated in Section 1 hereof not later than sixty (60) days from the date of adoption of this Resolution.

Section 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
