RESOLUTION NO. RS2006-1253

A resolution opposing the award of the security services contract to Wackenhut Corp.

WHEREAS, the Metropolitan Government of Nashville and Davidson County subcontracts security services for Metro facilities; and

WHEREAS, the Metropolitan Purchasing agent awarded a five year contract pursuant to RFP No. 05-93 to Murray Guard, at a cost to the Metropolitan Government of $19.7 million; and

WHEREAS, the Metropolitan Procurement Appeals Board recently overturned the purchasing agent's decision and awarded the contract to Wackenhut Corp. at a cost to Metro of $24.5 million over five years; and

WHEREAS, in awarding the security contract to the higher bidder, the Procurement Appeals Board considered employee benefits in scoring the bid, which caused Wackenhut's proposal to receive a higher score, despite the nearly $5 million additional cost; and

WHEREAS, the Metropolitan Hospital Authority is in need of a $6.7 million loan in order for General Hospital to survive as a going concern until June 30, 2006; and

WHEREAS, the Metropolitan Board of Public Education is faced with eliminating $7 million in its consideration of the budget for fiscal year 2007, including the elimination of 100 custodian positions; and

WHEREAS, in light of the financial situation facing General Hospital and our public schools, the Council finds it difficult to justify paying an extra $5 million for security services.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government of Nashville and Davidson County hereby goes on record as opposing the award of the security services contract to Wackenhut Corporation.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to David Manning, the Director of Finance, Jeff Gossage, the Metro Purchasing Agent, and to the members of the Procurement Appeals Board.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
