RESOLUTION NO. RS2006-1250

A resolution requesting the Mayor's Office of Neighborhoods to check the Tennessee Sexual Offender Registry on a weekly basis and notify neighborhood associations of offenders in their area.

WHEREAS, the Tennessee Sexual Offender and Violent Sexual Offender Registration, Verification, and Tracking Act of 2004, as amended in May 2005, requires sexual offenders to register with the Tennessee Bureau of Investigation (TBI) and provide certain information including their complete name, social security number, sexual offense(s) for which the person has been convicted, and their physical address; and

WHEREAS, the TBI maintains a website allowing persons to search for sexual offenders in Tennessee by name, city or zip code, however, the TBI does not send a notice to residents informing them that a sexual offender lives in their neighborhood; and

WHEREAS, many households in Nashville do not have internet access, and thus may have difficulty accessing the sexual offender list on a regular basis; and

WHEREAS, the stated mission of the Mayor's Office of Neighborhoods is to "improve the quality of life in Nashville's neighborhoods through a more informed, active and involved citizenry"; and

WHEREAS, it is fitting and proper that the Mayor's Office of Neighborhoods provide periodic updates to neighborhood associations informing them of sexual offenders living in their area.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor's Office of Neighborhoods to check the Tennessee Sexual Offender Registry on a weekly basis and notify neighborhood associations of offenders in their area.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Michelle Cummings Steele, the Director of the Mayor's Office of Neighborhoods.

Section 3. That the Mayor's Office of Neighborhoods is further requested to respond to the Council regarding the request identified in Section 1 hereof not later than sixty (60) days from the date of adoption of this Resolution.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
