SUBSTITUTE RESOLUTION NO. RS2006-1249

A resolution requesting the Metropolitan Board of Public Education to develop and implement a policy for the documentation of services offered to students and parents during the Eligibility Team meeting.

WHEREAS, the Individuals with Disabilities Education Act, as amended in 2004, requires that families of children with disabilities have meaningful opportunities to participate in the education of their children; and

WHEREAS, an Eligibility Team meeting is held prior to an IEP Team meeting to determine whether the child qualifies as being disabled; and

WHEREAS, the IEP Team is comprised of the parents, at least one of the child's regular teachers, a special education provider; and

WHEREAS, once a determination is made regarding the eligibility, an IEP Team meeting is held to develop an IEP plan; and

WHEREAS, a written or recorded record of the IEP Team meetings are currently not maintained by the Board of Education; and

WHEREAS, in keeping with the spirit of the Individuals with Disabilities Education Act, the Board of Education should develop and implement a policy to document the services offered to students and parents during the Eligibility Team meeting.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Board of Public Education to develop and implement a policy consistent with FERPA for the documentation of services offered to students and parents during the Eligibility Team meeting.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to Dr. Pedro Garcia, the Director of Schools, and to each member of the Metropolitan Board of Public Education.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
