RESOLUTION NO. RS2006-1234

A resolution approving and authorizing the Mayor to execute Amendment No. 1 to the contract with the State of Tennessee Department of Transportation for reevaluation of the existing Environmental Impact Statement for a portion of the Shelby Street - Demonbreun Street corridor.

WHEREAS, by Ordinance No. BL2004-423, the Metropolitan Council approved a contract ("Contract") with the State of Tennessee Department of Transportation providing for management, funding, and related matters for the reevaluation of the existing Environmental Impact Statement for that portion of the Shelby Street - Demonbreun Street corridor from Fourth Avenue South to I-40 West; and,

WHEREAS, the parties now wish to amend the terms of that Contract, as set forth in Amendment No. 1, a copy of which is attached hereto, and which Amendment is in the best interest of the Metropolitan Government; and

WHEREAS, Ordinance No. BL2004-423 provided that amendments to the Contract shall be approved by Resolution of the Metropolitan Council.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment No. 1 to the Contract between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee Department of Transportation providing for management, funding, and related matters for the reevaluation of the existing Environmental Impact Statement for that portion of the Shelby Street - Demonbreun Street corridor from Fourth Avenue South to I-40 West, as attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
