A resolution requesting the Tennessee Department of Transportation to install noise abatement walls along Interstate 40 between 46th Avenue North and 18th Avenue North.

WHEREAS, the Tennessee Department of Transportation is responsible for the construction and maintenance of state roads and highways; and

WHEREAS, residential neighborhoods were essentially bisected by Interstate 40 when it was constructed through north Nashville forty years ago, which has had a substantially negative impact on the community; and

WHEREAS, the section of Interstate 40 between 46th Avenue North and 18th Avenue passes through a densely populated urban area, with many residences in close proximity to the interstate; and

WHEREAS, noise abatement walls have proven to substantially reduce highway noise levels in residential areas, and have been used by the Tennessee Department of Transportation on numerous occasions; and

WHEREAS, this section of Interstate 40 has been identified as a "Type II" area for consideration of noise abatement; and

WHEREAS, it is fitting and proper that the Tennessee Department of Transportation construct noise abatement walls along the interstate in this highly populated area to prevent further destruction to the mental and physical health of the residents along this corridor.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Tennessee Department of Transportation to install noise abatement walls along Interstate 40 between 46th Avenue North and 18th Avenue North.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to Tennessee Department of Transportation Commissioner Gerald Nicely.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
