RESOLUTION NO. RS2006-1153

A resolution authorizing the compromise and settlement of the lawsuit of Carolyn Alexander against the Metropolitan Government for the amount of twenty-five thousand dollars ($25,000) and directing that this amount be paid out of the Self-Insured Liability Fund.

WHEREAS, Carolyn Alexander sustained injuries on December 10, 2001 when she tripped and fell over a hosepipe placed in a stairwell at the Metro Action Commission Ross Head Start Center; and,

WHEREAS, Carolyn Alexander filed suit against the Metropolitan Government, Mid-South Playgrounds, LLC. and Outdoor Recreation, Inc.; and,

WHEREAS, in contribution to the settlement of the lawsuit the Metropolitan Government is contributing twenty-five thousand dollars ($25,000), Mid-South Playgrounds, LLC is contributing twenty-five thousand dollars ($25,000) and Outdoor Recreation, Inc. is contributing seven thousand five hundred dollars ($7,500); and,

WHEREAS, the Department of Law believes that the settlement is fair and reasonable, and recommends that this lawsuit be compromised and settled as to The Metropolitan Government of Nashville and Davidson County, and that said amount be paid out of the Judgment and Losses Fund.

Now, therefore, be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Carolyn Alexander against the Metropolitan Government in the amount of twenty-five thousand dollars ($25,000), and that said amount be paid from the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
