RESOLUTION NO. RS2005-988

A resolution expressing the Metropolitan Council's intent regarding the appropriation to NEON/NRC/Art Works included in the fiscal year 2006 Operating Budget for the Metropolitan Government.

WHEREAS, on June 28, 2005, the Metropolitan Council enacted Substitute Ordinance No. BL2005-663, titled The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2006; and

WHEREAS, Substitute Ordinance no. BL2005-663 included a contribution in the amount of $85,000 from the General Fund of the General Services District to "NEON/NRC/Art Works" under account number 01101579; and

WHEREAS, in including this contribution as part of Substitute Ordinance No. BL2005-663, the Council intended that the $85,000 be divided equally among the three organizations; and

WHEREAS, the Council is of the understanding that NRC (Neighborhoods Resource Center) has received its non-for-profit tax exempt status from the Internal Revenue Service under the provisions of § 501(c)(3) of the Internal Revenue Code of 1986; and

WHEREAS, the Council is further of the understanding that Art Works is a subsidiary organization of NEON (North Edgefield Organized Neighbors), and that NEON is in the process of obtaining its tax exempt status from the Internal Revenue Service.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as stating that the Council intended that the contribution in the amount of $85,000 to NEON/NRC/Art Works included in Substitute Ordinance No. BL2005-663, The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2006, be disbursed as follows:
1. That the amount of $28,333.34 be appropriated to NRC (Neighborhoods Resource Center).
2. That the amount of $56,666.66 be appropriated to NEON (North Edgefield Organized Neighbors), with $28,333.33 of said amount being used by NEON for the Art Works program.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
