RESOLUTION NO. RS2005-980

A resolution approving an amendment to a grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, by and through the Board of Parks and Recreation, for Project Number HPP-9312(28).

WHEREAS, the Metropolitan Government of Nashville and Davidson County previously entered into a Grant Agreement with the State of Tennessee, Department of Transportation, for Project No. HPP-9312(28) relating to the Stones River and Mill Creek Greenways; and,

WHEREAS, that Grant Agreement was approved by Ordinance No. BL1999-1670; and,

WHEREAS, Amendment No. 1 to that Grant Agreement was approved by Resolution No. 1999-87; and,

WHEREAS, the parties wish to again amend that Grant Agreement to revise the terms and conditions therein and to extend the Grant Agreement indefinitely, a copy of which Amendment No. 2 is attached hereto; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this Amendment be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Amendment Number 2 to the grant by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, by and through the Board of Parks and Recreation, for Project No. HPP-9312(28), a copy of which Amendment is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this grant be appropriated to the Parks and Recreation Department based on the revenues estimated to be received and any match to be applied.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
