RESOLUTION NO. RS2005-920

A resolution accepting $9,577.12 in compromise and settlement of the Metropolitan Government of Nashville and Davidson County's claims against Mr. Troy Lacey for property damage and reimbursement of medical bills.

Whereas, on August 27, 2004, Troy Lacey attempted to make a left turn from Harding Place onto Beacon Drive and in so doing turned into the path of a Metropolitan Fire Department ambulance that was responding to an emergency call with emergency equipment activated; and

Whereas, the driver of the Metro ambulance attempted to avoid the collision but the ambulance was struck on the right side by Troy Lacey's vehicle, causing property damage and personal injury, and requiring medical treatment; and

Whereas, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that the claim be compromised and settled in the amount of $9,577.12 and that these funds be deposited into the appropriate fund and account as determined by the Department of Finance.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to accept the amount of $9,577.12 in compromise and settlement of the property damage and reimbursement of medical bills claims against Troy Lacey and to deposit said funds into the appropriate fund and account as determined by the Department of Finance.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
