RESOLUTION NO. RS2005-919
A resolution authorizing the Department of Law to accept $6,764.17 in compromise and settlement of the Metropolitan Government of Nashville and Davidson County's property damage claim against Appleway Equipment Leasing.
Whereas, on April
8, 2005, Mr. Craig Stucker, an Appleway Equipment Leasing employee, while making
a right turn from the center lane of 14th Avenue North onto Charlotte Avenue,
failed to see and struck a stopped Fire Department ambulance causing damage
to the ambulance owned by the Metropolitan Government of Nashville and Davidson
County; and
Whereas, after investigation, the Metropolitan Department of Law believes that
the settlement listed in Section 1 is fair and reasonable and recommends that
the claim be compromised and settled in the amount of $6,764.17 and that these
funds be deposited into the appropriate fund and account as determined by the
Department of Finance.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Department of Law is authorized to accept the amount of $6,764.17 in compromise and settlement of the property damage claim against Appleway Equipment Leasing and to deposit said funds into the appropriate fund and account as determined by the Department of Finance.
Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
